Abstract
This thesis systematically reviews the "safe third country" concept. First, it theoretically frames this instrument, demonstrating both its historical roots and contemporary motivations. By doing so, it reveals this measure's operational risks for refugees. Next, it assesses the obligations that international law imposes on States conducting transfers. It suggests that these protections are more robust than commonly thought, presenting another set of requirements that must be met from a human rights perspective. Finally, it applies both the legal and operational challenges to its study of the EU-Turkey Deal, suggesting that these forces converge in a feedback loop that ultimately harms refugees.
